【法政奄列】第42條的回歸（劉偉聰）

2020年6月30晚11時，新法君臨，我們全身（當然未必全心！）二次回歸，從此我城不再，不再我城！
在新法下，在法庭上，我們先要確認，主審法官是否林門鄭氏欽定指派的法官，否則一切隨風。哈！行政機關指定誰就誰來斷案，哪還有司法獨立？沒有司法獨立，哪還有約束行政機關霸道權力的法治？「毛之不全，皮將焉附？」我城丟棄了法治，還不是中共大灣區完美的一員？還不是使徒來襲後的終極回歸？
我痴頑，雖知其不可為，卻還勉力為之！新法下首宗案件提堂，關鍵是新法第42條的詮釋，「to be bailed or not to be bailed, that’s the question!」。
第42條頒下御旨：「對犯罪嫌疑人、被告人，除非法官有充足理由相信其不會繼續實施危害國家安全行為的，不得準予保釋。」若以普通法原則解釋，先以文本為根據，「除非……不得準（噢！當作「准」）予保釋。」這樣的句式，其字面意思是，新法的前設是嫌疑人不得保釋，除非咩咩又柒柒，這跟普通法的前設大相扞格。在普通法及我城適用的人權法下，個人自由是supreme，除非有合理合法的理由，否則不得隨意褫奪！現在是既倒行復逆施，試看以故麥高義大人（Gerald McCoy SC)在Siu Yat Leung案中的經典判詞：
‘However, I venture to suggest, that as a matter of constitutional law, because of the overriding imperatives in
(a) Article 28 Basic Law
"The freedom of the Person of Hong Kong residents shall be inviolable.
No Hong Kong resident shall be subjected to arbitrary or unlawful arrest, detention or imprisonment."
and (b) Article 5(3) Bill of Rights, Cap 383
"It shall not be the general rule that persons awaiting trial shall be detained in custody, but release may be subject to guarantees to appear for trial, at any other stage of the judicial proceedings, and, should occasion arise, for execution of the judgement."
and (c) as a bail application is but a vestigial form of habeas corpus under common law, (see s22A(14) High Court Ordinance and O54 RHC)
this Court could never be lawfully denied, by the Legislature, its quintessential power of adjudication in relation to liberty. That power is self-referentrial of its existence, and the Rule of Law depends on its undiminished virility and muliebrity.’
麥大人說：「法治既溫柔（muliebrity)亦鋼猛（virility)，關鍵是不容輕侮、不容褻玩（undiminished)，故法院不應受強權所限（could never be lawfully denied），這種undiminished的權力才是我們自由之所似。
新法帶頭diminish我城法院的權力，抬舉法律，卻貶低法治！我們翹首，淚便心裏流。
